Late last night the New York State Senate passed an array of legislation, but the one bill that might impact our area the most
was a measure requiring prisoners be counted as residents not of the (mostly upstate) prisons where they reside, but where they lived before they were incarcerated (most often, New York City). “Most of the state’s prisoners (66 percent) are New York City residents, but the vast majority of them (91 percent) are counted as residents of upstate prisons,” according to Prisoners of the Census. Senator Eric T. Schneiderman, a Manhattan Democrat running for attorney general told The New York Times, “If other states follow us, it would represent a major shift of political power back to these poor urban communities.” Indeed, this bill would mean that Greene County would lose a sizable portion of its population, and all sorts of funding could be lowered to reflect that change. The inmates inside Coxsackie Correctional Facility (approximately 1,000) at 11260 Route 9W; Greene Correctional Facility, 165 Plank Road, Coxsackie; and the Hudson Correctional Facility (about 600) at 50 East Court St. in Hudson; would no longer be counted as local residents. The Greene County Planning and Economic Development site counts 3,280 “institionalized” people, or 6.8 percent, many of which would, presumably, be counted elsewhere if this measure were to become law. Since the Hudson Correctional Facility is located in the Third Ward, it would reduce the weighted votes of the Third Ward aldermen. The votes of Aldermen Ellen Thurston and Chris Wagoner now each represent 266 toward the 1,011 needed for a simple majority. The only votes on the Common Council more powerful than theirs are those cast by Aldermen Robert Donahue and Richard Goetz, whose votes weigh in at 278 each. Coxsackie would obviously face similar “re-districting” if this measure is passed, and possible local funding tied to population could be lost, and perhaps fewer regular visits from State Assemblyman Pete Lopez, State Senator James Seward, and Congressman Scott Murphy as their districts might be enlarged geographically to make up for the loss of prison population. Clearly, Seward is worried about the proposal, as he told The Daily Mail: “I clearly see this as a move to dilute the upstate population numbers to benefit downstate,” he said. Susan Campriello in The Daily Mail reports:

“According to a 2002 report Prison Policy Initiative report by Peter Wagner, roughly 3,000 constituents could be removed from Seward’s district. Such losses could decrease the area’s population to nearly 6 percent below the required average district size of 306,072.”… Three facilities are located in [Seward's] district, which includes all or portions of seven counties. Two facilities are in Coxsackie, one is in Summit, in Schoharie County. Read the entire story in The Daily Mail.

Scott Murphy at Coxsackie Senior Center April 1, 2010.

Congressman Scott Murphy (NY-20) announced today that Mid-Hudson Cablevision will receive $3,473,919 in USDA funding for rural broadband infrastructure projects. Murphy sent letters and made calls in support of Mid-Hudson’s application, in addition to working with the USDA. Murphy says the funding will allow Mid-Hudson Cablevision to expand coverage in Columbia and Greene counties, specifically the Towns of Ashland, Jewett, Lexington, Cairo, Catskill, Windham, Coxsackie and New Baltimore in Greene County, and The Towns of Taghkanic, Copake, Claverack, Ghent, Chatham, Hillsdale and Austerlitz in Columbia County. “Expanding rural broadband in our Upstate communities is key to building businesses and creating jobs,” said Rep. Murphy in a press release. “This project will benefit everyone from farmers and small businesses looking to sell their products online, to volunteer firefighters needing high-speed Internet to keep the public safe.” In Murphy’s press release, James Reynolds, president of Mid-Hudson Cablevision, said, “This government support will help make it possible to extend service to rural marketplaces that would otherwise be very difficult reach.”

Capitol Confidential is reporting that, “Republican Congressional candidate Chris Gibson’s hopes of contesting Democratic Rep. Scott Murphy for the Independence Party line have come to naught.” “Very nice candidate, very nice man,” said Tom Connolly, vice chairman of the party’s executive committee, of Gibson. “But the committee decided to go with Scott Murphy, who is our candidate.” Kinderhook’s Gibson will appear on the Republican and Conservative Party lines, and Murphy will be on the Democrat, Working Families, and Independence party lines in November’s election to represent Greene and Columbia counties in the 20th District in New York. Chris Gibson has apparently raised more money in the last three months than Rep. Scott Murphy, the Glens Falls Democrat he seeks to unseat. But Murphy still has 2.5 times as much money in the bank as Gibson, a retired Army colonel from Kinderhook. Both men will report on their campaign’s donations and expenditures by Thursday. But sources familiar with each of the campaigns offered preliminary peeks at their totals. Murphy, who won a special election to replace now-Sen. Kirsten Gillibrand in 2009, raised just over $350,000 this quarter and now has $1.3 million on hand…. Gibson raised around $487,000, a person familiar with his filing said, confirming a report posted Monday on Politico.com. He raised $108,000 in the first month of his race, according to the last quarterly filing, and now has about $500,000 on hand…. Gibson spokesman Rob Clark said the campaign is still in the process of compiling its filing, and declined to give an exact number. Kinderhook-based Republican candidate Chris Gibson‘s couple of months attacking incumbent Scott Murphy with the Democrat not mentioning his future opponent’s name are over. Today Murphy’s staff released the following press release:

“Today, Congressman Scott Murphy’s campaign called on Chris Gibson to let the voters of the 20th District know whether he stands with Main Street or Wall Street. In an attempt to play both sides, Chris Gibson has refused to answer newspapers across the district when asked how he would have voted on Wall Street Reform. ‘The Wall Street reform bill that Congressman Murphy helped pass last week is going to end taxpayer funded bailouts and prevent another financial crash like the one that just cost us eight million American jobs,’ said Mitch Wallace, campaign spokesperson. ‘Yet Chris Gibson has refused to say whether he would have voted yes or no on the bill. Chris Gibson needs to stop dodging questions and let the people of the 20th District know whether he stands with Main Street or Wall Street.’”

“The bill has some good components, but it also has many flaws,” said Gibson. [7/2/10, Hudson Register Star]

Gibson’s staff responded with:

“Unlike Mr. Murphy I would represent all the citizens of the 20th District, not the special interests he has consistently taken his marching orders from. Our campaign advocates growing the private sector economy by removing the impediments to growth with targeted tax and regulatory relief and by
repealing and replacing that disastrous health care bill. And we advocate for restoring fiscal responsibility by balancing the budget through reduced federal spending, not new taxes. Time and again Mr. Murphy has followed the orders of Speaker Pelosi and the Obama Administration voting for bills that hurt our district, bills such as health care, cap and trade and co-sponsoring card check legislation. I have stated all along I opposed the Dodd-Frank Bill because it does not solve the root cause of the Wall Street meltdown. Although I do like certain aspects of the Bill, by not reforming Fannie Mae and Freddie Mac the taxpayers will continue to be vulnerable to bail outs of failed government policies for years to come. I noticed in a recent article that Mr. Murphy described the Dodd-Frank bill as ‘big.’ We certainly agree on that. This bill, weighing in at over 2,000 pages and creating yet more new big government at a time when we clearly need to reduce the size of government, is more bad legislation we don’t need. In addition to Fannie and Freddie, we need more transparency in actions that involve public monies. We have federal agencies now that are responsible for that – the SEC and FED. What we should have done is reform these existing agencies – not create new ones. Mr. Murphy has once again sided with special interests and against the interests of citizens in our district. Mr. Murphy’s policies not only hurt those living on Main Street, they hurt people living in our suburbs, rural areas and farms. This must change. In November our voters will have the opportunity to elect new leadership and a true voice for the people of the 20th district. I have proven leadership you can count on and am ready to answer that call.”

Leigh Hornbeck in Capitol Confidential mysteriously calls different ideas “similar”:

Congressman Scott Murphy and his challenger, Republican Chris Gibson, have similar things to say about illegal immigration. After an appearance at a joint meeting of local chambers of commerce, Murphy said he understands why Arizona enacted a law that gives police power to question anyone they suspect of being in the country illegally and makes failing to carry immigration papers a crime. “They acted independently because there is no federal policy that works. We can’t have 50 states with different policies, we need immigration reform. I’m hopeful, but not optimistic,” Murphy said. He would not comment on criticism of the law that it is racist. Yesterday, the Gibson campaign released a statement criticizing the U.S. Justice Department for suing Arizona and calling the law unconstitutional. “This lawsuit is a misguided effort by the federal government. Our federal government has continually failed to provide leadership in securing our borders. Since the federal government has failed, it is only natural that the state of Arizona steps up to protect its borders,” Gibson [who lives in Kinderhook] said. The campaign between incumbent Democrat Scott Murphy and Republican candidate Chris Gibson for New York’s 20th Congressional seat (which represents Columbia and Greene counties) heated up today, on the eve of the second quarter contribution reporting deadline. Gibson lagged far behind Murphy in fundraising in the first quarter of the year, and today is the last day of the second quarter, and I’m sure the Gibson campaign and Republican organizers would like to announce a large contribution figure in the next few days. The Albany Times-Union’s excellent blog Capitol Confidential reported today that, “A column penned by Brian Walsh, political director of the National Republican Campaign Committee, listed the race as a “toss-up” according to Cook Political, in an article that was promptly posted on Gibson’s website and included in [a] fundraising e-mail he blasted to his supporters.” Actually, Cook, fivethirtyeight.com, and most other respected polling organizations have called the district leaning Democrat this fall. “David Wasserman, the [NRCC]’s House editor, said he has “no idea” why the NRCC cited the race as a toss-up. I called John Randall to ask, and the NRCC spokesman said “that was an oversight on our part and it’s in the process of being fixed.” Indeed, when I looked at Walsh’s column today it had already been updated. As of 4 p.m. it still listed Murphy as having voted for the stimulus bill, which passed before he was a member of the House. (Murphy said during his campaign he would have voted for the measure, and has been full-throated in declaring his support of it.) Rob Clark, a spokesman for Gibson’s campaign, did not immediately offer a comment on why it was included in the e-mail.”

Murphy did vote today for the Wall Street Reform conference report, which passed the U.S. House of Representatives today and is expected to clear the Senate and get a signature from President Obama. “I came to Congress a year ago as a small businessman to solve problems, and one of the critical problems facing the United States right now is how to regulate our financial industry,” Murphy said in a statement today. “That is why I am proud to have taken this critical step to ensure that never again can Wall Street melt down and leave Main Street to pay the price. By ending taxpayer bailouts for big banks and creating strong consumer protections, we will not only strengthen our economy, but hold Wall Street accountable.” Gibson, meanwhile, announced today his July 4 weekend schedule, and it includes one local stop, at Kinderhook’s annual People’s Day Parade. Gibson and his family will be marching in the parade, then the candidate will address the crowd from the bandstand in the Village Square. The parade begins at 11 a.m. at Rothermel Park, Gibson speaks around 11:30 a.m.

When Congressional candidate Chris Gibson held a fundraiser with Rep. Tom Price after Price said the creation of a $20 million BP-funded escrow account illustrated that the Obama Administration “is hard at work exerting its brand of Chicago-style shakedown politics,” the DCCC called foul. Yesterday, Gibson [from Kinderhook] struck back and said his opponent, Rep. Scott Murphy, accepted money from BP – $1,000 in November, 2009. That’s true, but according to Murphy’s office, the congressman donated the money to the National Wildlife Federation June 9. Campaign spokesperson Mitch Wallace released this statement: “Congressman Murphy donated that money to the National Wildlife Federation weeks ago to go towards cleaning up the gulf. Actions speak louder than words. If Chris Gibson is going to talk about personal responsibility he should demonstrate some and give back the money he raised with British Petroleum’s defender Rep. Chris Gibson, a Republican hoping to unseat Rep. Scott Murphy [in District 20, which covers Greene and Columbia counties], forcefully repudiated remarks by a sitting Republican congressman who apologized to BP CEO Tony Hayward for what he saw as a “shakedown” being perpetuated by the Obama administration. Rep. Joe Barton, R-Texas, made the comments during a House hearing last week. He said he was “ashamed” of President Barack Obama’s call for BP to set aside a $20 billion “slush fund” for claims from the Gulf oil spill. The comments were widely criticized by Democrats, and Barton later apologized for his use of the word “shakedown.” “Just as I believe in individual responsibility, I believe in corporate responsibility. They need to be held responsible for their actions, so as we go forward, we absolutely need to continue towards that end: holding BP responsible for this. Now, we do need to take a hard look at how we do this drilling,” Gibson, a retired Army colonel from Kinderhook, said Monday. “That was an outrageous comment by Mr. Barton and I disassociate myself from him. Again, I lead in with the fact that I believe in individual responsibility and I believe in corporate responsibility.” His rebuke came a day before a scheduled fundraiser this evening in Washington with three incumbent GOP congressman — including one who has also called the claims fund a “shakedown.” The event — for which political actions committees are asked to contribute $1,000 — is headlined by Reps. Peter King, R-N.Y., Geoff Davis, R-Ky. and Tom Price, R-Ga. Price, chairman of the conservative Republican Study Committee, issued a statement last week. A Gibson spokesman did not immediately explain the apparent contradiction. Gibson later issued a statement saying “I believe in individual responsibility and corporate responsibility and that BP should be held accountable for their actions. Rep. Scott Murphy got attacked from the left last week, for a letter sent to the FCC that net neutrality proponents claim was parroting big Telecom. Murphy and 73 other Democrats allegedly, “sold you out to AT&T, Verizon and Comcast,” targeted e-mail messages sent to constituents in the districts of Murphy and the other members of Congress who signed a letter to FCC Chairman Julius Genachowski on May 24 asserted. A letter from Working Assets, the progressive long-distance service, and their “CREDO Action” group says, “They signed industry-backed letters telling the FCC to abandon efforts to protect Internet users by prohibiting big companies from blocking Internet traffic.” Another e-mail from Timothy Karr at Free Press Action Fund said, “Almost every one of these representatives has accepted massive contributions from the phone and cable lobby. Now the industry is demanding a return on its investment.” Murphy’s staff lined up to defend their boss last week, with chief of staff Todd Schulte sending out an e-mail to supporters saying, “Congressman Murphy is in favor of an open Internet to benefit consumers and technological innovation. The email claims the letter states Scott is opposed to net neutrality – the letter says no such thing.” Yes, the letter Murphy signed is vague, but can easily be read as threatening to net neutrality proponents. Schulte also says Murphy favors, “dramatically expand[ing] broadband access, and that we need an internet regime that protects and benefits consumers first and foremost. Scott has concerns about using a decades old provision to regulate a medium totally unimagined when the telephone network first expanded across the nation.” Search Murphy’s website for the phrase “net neutrality” and “No documents match your query.” But search the OpenSecrets website, and Karr seems wrong about at least Murphy’s campaign coffers. Attacks on Murphy from the right may begin again, as on Friday, he voted to repeal the military’s “Don’t Ask, Don’t Tell” policy, which passed the House, 234-194.

U.S. Rep. Scott Murphy, the Democrat from Glens Falls who represents Columbia and Greene counties, ranked 370 of 435 with $6.09 million federal pork-barrel funds for local projects, according to the Council for Citizens Against Government Waste’s annual “Pig Book,” William J. Kemble reports in The Daily Freeman. In comparison, longtime U.S. Rep. Maurice Hinchey, who represents an area just south of Murphy’s district, ranked 50th with $54.96 million in projects. Murphy has served less then one full term. Murphy recently posted his appropriations requests online. Murphy is facing Republican Chris Gibson this fall.

The Chris Gibson for Congress Campaign has opened its headquarters at 12 Broad Street directly across from Bagel Tyme cafe in the village of Kinderhook. The campaign invites neighbors and friends from Columbia County to meet the candidate on May 13 from 5 to 8 p.m. Kinderhook-native Gibson is the Republican nominee to challenge incumbent Democrat Scott Murphy to represent New York’s 20th District.

    The Republican Congressional candidate Chris Gibson would abolish the Department of Homeland Security, and says the American Recovery and Reinvestment Act was “a loser for our country, but especially for our area,” in an interview with Jimmy Vielkind in the Albany Times-Union. He writes: “[Gibson] said that the regional management of the conflict is good — he even said that President Barack Obama has made “good choices” in managing the conflicts in Iraq and Afghanistan — but the separation between military efforts and civil defense, or homeland security measures, must be improved.” The Kinderhook conservative is challenging incumbent Democrat Scott Murphy for New York’s 20th Congressional District seat. Scott Murphy, D-Glens Falls, voted to reject a congressional pay raise for the coming federal fiscal year….Members of Congress receive an automatic annual cost-of-living adjustment, unless Congress votes specifically to reject it, as the House did overwhelmingly this week….Salary for House members would remain at $174,000 annually.     Rep. Scott Murphy paid $23,100 in the last three months to Global Strategy Group, a Democratic polling firm which recently paid a $2 million settlement in connection with a pay-to-play investigation. Murphy’s quarterly filing shows the payments to Global were made on Feb. 4 and 24 for polling. They were Murphy’s largest expenditures (others include payments to Act Blue, for Murphy’s fund-raisers and some travel) of the quarter, during which he raised $475,000. Global Strategy Group acknowledged to Cuomo’s investigators that they acted as an unlicensed placement agent when they arranged a meeting with Intermedia Partners and Comptroller Tom DiNapoli in 2007. Intermedia’s investment from the state’s common retirement fund was increased thereafter. The firm has many marquis Democratic clients: it advised former Gov. Eliot Spitzer in his 2006 election and is currently on retainer to Sen. Kirsten Gillibrand. Murphy has used Global as his pollster since his 2009 special election. Gillibrand’s Republican opponent David Malpass has called on her to break with Global, and other Republicans (including Doug Hoffman, the likely Conservative Party candidate against Rep.     Later Thursday, Chuck Pinkey of Otego said another Tea Party Protest will be held at River Valley New Holland in Otego on Saturday, April 24. Among those to speak that Saturday will be state [New York State] Sen. James Seward (who represents Greene County], R-Milford, and two Republican congressional candidates, Richard Hanna of Barneveld and [Republican Congressional challenger in the NY-20 race against Scott Murphy] Christopher Gibson of Kinderhook, he said.

    According to this Daily Star letter to the editor, the protest will be from 1 to 4 p.m. at River Valley Ford, which is about halfway between Oneonta and Otego on Route 7.

    Chris Gibson, the retired Army colonel from Kinderhook who is running against Rep. Scott Murphy, has raised $108,000 toward his race against Rep. Scott Murphy. According to his quarterly FEC filing, Gibson has $91,825.97 on hand for his run against Murphy, a freshman Democrat from Glens Falls. Murphy’s quarterly disclosure is not yet filed (it’s due tomorrow) but his aides have indicated he raised $475,000 this quarter, bringing his total war chest to $1.1 million. Gibson formally declared his candidacy March 6, and said he would report a “respectable” amount of money, that would make him competitive “in the air” against Murphy.     Democrat Congressman Scott Murphy (NY-20) held a town hall meeting at 2 p.m. today in Coxsackie at the Senior Center (formerly Knights of Columbus building) at 127 Mansion St., with several constituents asking him about his recent “yes” vote on the health care reform bill.     Yesterday the U.S House of Representatives passed on a voice vote, HR 1147, the Local Community Radio Act of 2009. This bill will expand the low-power FM program, and allow communities throughout the country to have access to their own airwaves via their own community radio stations. A spokesman for Rep. Scott Murphy (D-NY20), who represents Greene and Columbia counties, says the congressman supported the measure. Now Senate bill 592 must pass that half of Congress before the bill goes to President Obama for a signature or veto.

    Murphy speaks locally about health care

    Several hundred local residents and others from outside the area turned up this morning at 11 a.m. at The Golden Harvest Farm in Valatie to hear U.S. Representative Scott Murphy (D-20) talk about and answer questions about the health care before Congress. While similar meetings in other Congressional districts have turned into shouting matches and even brawls, this debate was mostly civil, with just a bit of shouting, and mostly respectful questions from all sides of the political spectrum from the crowd of around 400.

    There seemed to be as many people who did not want the government providing any health care at all as there were folks who favored a single-payer system, judging by Murphy’s poll of the crowd at the end. Of course, by then, after over an hour in the hot sun, the group was much smaller then at the beginning, and perhaps only folks with very passionate political positions remained.     Judge rules against Overbaugh ballot bid

    Linda L. Overbaugh’s name will not appear on the Republican primary ballot next month for one of the four Catskill seats on the Greene County Legislature, a judge ruled Thursday. Dick May from the Seeing Greene blog scooped everyone, reporting Thursday that Supreme Court Judge Richard M. Platkin ordered the Executive Director of the Heart of Catskill Association off the ballot, after her name was listed incorrectly on petitions. She was listed as Linda H. Overbaugh, her former cousin-in-law, who also lives in Catskill. For the lawsuit, Patricia J. Ruck, who chairs the Town of Catskill’s Democratic Party Committee, adopted the Citizen Objector role, while Forest Cotten, past Catskill Democratic chairman and present candidate for re-election to the county legislature, was designated as Aggrieved Candidate. Overbaugh was expected to win a slot in the legislature, perhaps costing incumbent Cotten his seat. Overbaugh told Seeing Greene “it’s not over,” perhaps hinting she will start a write-in campaign for the September primary, where voters would have to write in “Linda L. Overbaugh” exactly. Where was The Daily Mail on this story? They were bested by The Greenville Press for a week before the ruling, and then only mentioned this story for the first time today, two days after May’s story.

    Town & County magazine writes about Hudson
    The September 2009 issue of Town & Country magazine (with actress Jane Krakowski on the cover) features a large story about Hudson’s antique stores called “A Hudson River Renaissance.” Hopefully, the story will help merchants there struggling during this recession — one antique store owner told me in Febraury he did not make a single sale.

    Nonprofit’s report cites lack of slaughterhouses in New York

    Andrew Amelinckx writes an excellent story based on a report by Washington D.C. based consumer watchdog group Food and Water Watch that finds not enough slaughterhouses in New York state and blames federal policies that, it says, favors larger operations. There are two USDA certified slaughterhouses in Columbia County, Van Wie in Stockport and Hilltown Pork, Inc. Robert Beckwith of Hilltown Pork says he is backed up with animals until 2010. “People want to know where their meat is coming from,” he said. “There aren’t enough USDA facilities to meet the demand.”

    Murphy plans steps to help dairy farmers

    With milk prices falling to 1979 levels and New York dairy farmers expected to lose $650 million this year, new U.S. Rep. Scott Murphy plans to introduce legislation to help. The proposed legislation would further subsidize dairy farmers, and create a herd retirement program meant to curtail supply. “This proposal works two-fold, by providing immediate relief to our struggling dairy farmers today, and stabilizing the dairy industry for tomorrow. Before more small farmers are forced out of business, we need to bring fast relief and stability to the industry.”

    Lates poll: Maloney 33% Gillibrand 27%

    In a very early poll, New York City congresswoman Carolyn Maloney leads appointed Senator Kristen Gillibrand with 33 percent of the vote to 27 percent and nine percent preferring some other candidate. Thirty percent are undecided.
